Terms and Conditions

These Terms govern your use of www.byteaxistech.com (the "Website") and explain how you may use it. ByteAxisTech ("we", "us") provides its services under separate written terms, described in section 2. By using the Website you accept these Terms.

1. The Website

The Website provides information about ByteAxisTech and its services. Its content is general and does not amount to professional advice for your specific situation. We may change or remove content at any time.

2. Our Services

We offer cybersecurity services and consultancy; infrastructure design, development and deployment; network configuration; implementation of third-party security solutions; and AI model development.

• Each engagement is governed by a signed proposal or statement of work together with our General Terms and Conditions of Service (together, the "Engagement Terms"), which define scope, deliverables, timelines, fees, and liability. These website Terms do not form part of an engagement.
• Descriptions on the Website are not offers. A service begins only when both parties sign the Engagement Terms.
• If the Engagement Terms conflict with these Terms, the Engagement Terms prevail for that engagement.

3. Security Testing Requires Written Authorization

Security assessments, penetration testing, and VAPT can disrupt systems and are lawful only with permission. Contacting us through the Website does not authorize any testing. Before we test anything, the client must:

• Provide written authorization, signed by someone with authority over the systems in scope.
• Confirm that you own the systems or have the right to authorize testing, including systems hosted by third parties such as cloud or telecom providers, whose approval you must obtain where needed.
• Agree the scope, testing windows, and contacts for emergencies.

We will not test systems outside the agreed scope. You are responsible for backups and for informing anyone who needs to know about the testing. Despite our care, testing carries an inherent risk of service interruption or data impact, which the Engagement Terms will address.

4. Your Responsibilities

• Give us accurate information and timely access, people, and decisions that the work needs.
• Keep any credentials, accounts, or access we give you secure.
• Comply with the laws that apply to your business and your use of our deliverables.

5. Confidentiality

Each party will keep the other's non-public information confidential, use it only for the engagement, and disclose it only to those who need it and are bound to confidentiality, or where law requires. We handle client findings, vulnerabilities, and data with particular care. This duty continues after the engagement ends. We will sign a separate NDA on request.

6. Intellectual Property

• The Website, its content, our name, logo, and methods belong to ByteAxisTech or its licensors. You may not copy or reuse them without written permission.
• Unless the Engagement Terms say otherwise, deliverables created specifically for you become yours once you have paid in full. We keep our pre-existing tools, templates, and know-how, and grant you a licence to use them as part of the deliverables.
• Third-party products we supply or implement are licensed under their vendors' terms, not ours.

7. Fees

Fees, taxes, and payment terms are set out in the Engagement Terms. Nothing on the Website is a quotation unless it says so.

8. No Guarantee of Security

Cybersecurity cannot be absolute. Information on the Website is general, and our work reflects conditions at the time and the information available to us. We do not guarantee that systems are free of vulnerabilities, that attacks will be prevented, or that anyone will pass an audit or obtain a certification or regulatory approval. Decisions by regulators, certification bodies, and auditors are theirs alone.

9. Third-Party Products and Services

We resell or implement products from other vendors. We are not responsible for their performance, availability, or terms, beyond our own implementation work and any warranty we give in writing.

10. Acceptable Use of the Website

You agree not to:

• Attempt to gain unauthorized access to the Website or its infrastructure, or run scans or tests against it without our written permission.
• Introduce malware, or interfere with how the Website works.
• Use the Website for unlawful, fraudulent, or abusive purposes.
• Scrape or copy content in bulk.

If you find a vulnerability in our Website, please report it to info@byteaxistech.com and give us reasonable time to fix it before any disclosure. We will not take action against good-faith, responsible reports.

11. Disclaimer

The Website is provided "as is" and "as available". To the fullest extent the law allows, we give no warranties about its accuracy, availability, or fitness for a particular purpose. Nothing in these Terms excludes liability that cannot be excluded by law.

12. Limitation of Liability

Liability for our services is governed by the Engagement Terms. For the Website, to the extent the law allows, ByteAxisTech is not liable for any indirect or consequential loss, or for any loss arising from your use of, or reliance on, the Website or its content.

13. Your Responsibility

You are responsible for your use of the Website and for any loss to ByteAxisTech caused by your breach of these Terms.

14. Termination

Either party may end an engagement as the Engagement Terms provide. We may suspend access to the Website if you breach these Terms. Sections that by nature should continue, such as confidentiality, intellectual property, liability, and governing law, survive termination.

15. Governing Law and Disputes

These Terms are governed by the laws of Pakistan. The parties will first try to resolve any dispute through good-faith discussion. If that fails, the courts of Karachi will have exclusive jurisdiction. Disputes arising from an engagement are governed by the dispute clause in the Engagement Terms.

16. General

• Entire agreement: these Terms, with the Engagement Terms, are the full agreement between us on their subject.
• Changes: we may update these Terms; continued use of the Website means you accept the new version.
• Severability: if any provision is unenforceable, the rest remains in force.
• No waiver: delay in enforcing a right does not mean we have given it up.
• Assignment: you may not transfer your rights without our written consent.
